If someone starts working for an employment agency, the employment agency is the employer of this person. The employment agency must therefore adhere to the same privacy rules as other employers.

Can my employment agency transfer my citizen service number (Dutch: BSN) to a client?

Yes, that is permitted. If you are employed by an employment agency, it can transfer your citizen service number to a client who hires you as an agency worker.

The client can therefore appeal for a moderation of the recipients’ or vicarious tax liability. This is regulated in the Implementing Regulations to the Mandatory Use of Citizen Service Numbers.

Do I have to be screened again for every secondment?

No, it is usually not necessary for you to undergo screening again every time your employer seconds you or lends you to another organisation. Unless special (safety) requirements apply to working at this other organisation, or if the organisation can demonstrate that screening is necessary for another reason. Can I access my data at an organisation, or have them rectified or removed?

Yes, you can. If an organisation uses your personal data, you have a number of rights. This will ensure that you keep a grip on your personal data. These are the most important privacy rights:
