Consultation meaningful human intervention in algorithmic decision-making
The Dutch Data Protection Authority (AP) is developing a practical tool for meaningful human intervention in algorithmic decision-making. To ensure this document aligns with real-world practices, the AP invites companies, organizations, experts, and stakeholders to provide input through a consultation.
Organizations are increasingly using algorithms and artificial intelligence (AI) for algorithmic decision-making. For example, for assessing credit applications or reviewing online job applications. If organizations want to make use of algorithmic decision-making, they must comply with regulations. Individuals have the right to human intervention in algorithmic decisions that affect them. The GDPR sets rules for this.
Meaningful intervention
Human intervention should ensure that decisions are made carefully and prevent people from being unintentionally excluded or discriminated against by an algorithm. This intervention should not be merely symbolic; it must meaningfully contribute to the decision-making process.
Proper implementation is key
The way meaningful human intervention is structured is crucial. For example, if an employee is hindered by time constraints or an unclear system, this may affect the decision’s outcome.
Organizations often have questions about how to implement this effectively. Therefore, the AP is developing a tool for meaningful human intervention in algorithmic decision-making. To ensure these guidelines align with real-world practices, the AP is seeking input from businesses and organizations through a consultation.
